What Type of Criminal Defense Do You Need in South Carolina?

Criminal cases in South Carolina are broken down into a few different categories. As a very general rule, crimes that are punishable by three years or less are considered misdemeanors in South Carolina. Anything punishable by more than three years in prison is usually classified as a felony.

Federal and State Cases

Crimes can be classified as either state crimes or federal crimes, depending on whether they violate state laws or federal laws. The decision on which category to pursue charges under is typically made by the prosecutor. Generally speaking, crimes such as assault, robbery, domestic violence, theft, and rape are considered state crimes. Federal crimes, on the other hand, may include computer crime, major drug trafficking, hate crimes, and money laundering, which are often handled by agencies like the FBI or IRS.

Plea Deals

It's common for cases to be resolved outside of court. A plea deal allows the defendant to admit guilt to one or more charges without having to go through the trial process. In fact, your criminal defense attorney in Anderson, SC, and the prosecutor of your case work together to reach a mutually agreeable deal, to avoid the risks and unpredictability of a trial. By taking a plea deal, you may receive a reduced sentence and avoid the stress of a full-blown legal battle.

Misdemeanor vs. Felony Cases in South Carolina

For the average person charged with their first crime, understanding the difference between a misdemeanor crime and a felony crime can be hard to grasp. In simple terms, misdemeanors are usually considered petty crimes. They often result in fines and can involve time already served at a local county jail. Trials and plea deals for such offenses often move quickly due to their nature.

On the other hand, felonies are much more serious crimes that are classified by degrees. The most severe of these are first-degree felonies, while the least serious are sixth-degree felonies. When someone is charged with a felony, they may face hefty fines and a prison sentence of over a year in a federal or state institution. Those who have been convicted of a felony may encounter difficulties after their release, which is why it's crucial to have a reliable criminal defense attorney.

SC Code Section 16-1-20 provides us with a helpful penalty outline as it relates to felonies and misdemeanors:

  • For a Class A felony, the maximum sentence is 30 years.
  • For a Class B felony, the maximum sentence is 25 years.
  • For a Class C felony, the maximum sentence is 20 years.
  • For a Class D felony, the maximum sentence is 15 years.
  • For a Class E felony, the maximum sentence is 10 years.
  • For a Class F felony, the maximum sentence is 5 years.
  • For a Class A misdemeanor, the maximum sentence is 3 years.
  • For a Class B misdemeanor, the maximum sentence is 2 years.
  • For a Class C misdemeanor, the maximum sentence is 1 year.

It's important to note that these are maximum sentences, and the actual sentence may be less depending on the specific circumstances of the crime.

ANDERSON, S.C. —

Thanks to the arrival of two new babies at an Upstate farm, there's hope for a rare and endangered species living in South Carolina.

Split Creek Farm in Anderson County was originally home to the only female Royal Golden Guernsey in the United States named Renata. That is until she gave birth to two females Thursday morning.

For years, the co-owner of the farm, Jessica Bell has been a part of an effort to help the dying population of Royal Golden Guernseys. The particular breed of goat was given a royal title in 2024 by King Charles III signifying their importance to Europe.

"So to get two girls is amazing. You know, you need boys and girls. And we only had one girl left in the whole United States. So, to have two more is a really big deal to trying to try and, preserve this breed," Bell said.

Once Renata became of age, Bell and her team worked to secure the best guy for the job using semen from male Royal Golden Guernseys.

"We have worked with England, starting in 1997, to bring some of those genetics to the United States. Through embryos and through semen and through that process for trying to, replenish the breed in this area of the world as well," Bell said.

Renata gave birth Thursday morning around 6 a.m.

"Within 25 minutes, we were delivering babies. Obviously the first thing you do is make sure they're healthy, make sure they're breathing. Airways are clear. Second thing you do is check and see what you get, you know, this was like the best gender reveal we could have had," Bell said.

Now, Split Creek Farm has the only three females of the entire species in the United States but Bell said their work is far from over. Once the two baby girls grow to be 2 years old and healthy, they will try again for more.

"You know, obviously with such a small, close gene pool, we want to look at the most genetic diversity we can get so that we're carrying on the good traits of the breed. So, we will raise these girls out, keep them healthy, and when they're of age, we'll pick out, pick out the best possible combinations so that we can hopefully have more girls," Bell said.

According to Bell, there are now 10 Royal Golden Guernseys in the U.S. with an estimated 2,000 globally.
