Selecting the best criminal defense lawyer for your case in South Carolina often means the difference between freedom and conviction. When your future is on the line, contact Lauren Taylor Law to work with a fierce advocate willing to fight for your rights. Of course, when you've been charged with a crime, having extra knowledge about South Carolina law can go a long way. Before we touch on some of our specialties, it's important for you to understand the various types of criminal defense cases in South Carolina.
Criminal cases in South Carolina are broken down into a few different categories. As a very general rule, crimes that are punishable by three years or less are considered misdemeanors in South Carolina. Anything punishable by more than three years in prison is usually classified as a felony.
Crimes can be classified as either state crimes or federal crimes, depending on whether they violate state laws or federal laws. The decision on which category to pursue charges under is typically made by the prosecutor. Generally speaking, crimes such as assault, robbery, domestic violence, theft, and rape are considered state crimes. Federal crimes, on the other hand, may include computer crime, major drug trafficking, hate crimes, and money laundering, which are often handled by agencies like the FBI or IRS.
It's common for cases to be resolved outside of court. A plea deal allows the defendant to admit guilt to one or more charges without having to go through the trial process. In fact, your criminal defense attorney Near Me Seneca, SC, and the prosecutor of your case work together to reach a mutually agreeable deal, to avoid the risks and unpredictability of a trial. By taking a plea deal, you may receive a reduced sentence and avoid the stress of a full-blown legal battle.
For the average person charged with their first crime, understanding the difference between a misdemeanor crime and a felony crime can be hard to grasp. In simple terms, misdemeanors are usually considered petty crimes. They often result in fines and can involve time already served at a local county jail. Trials and plea deals for such offenses often move quickly due to their nature.
On the other hand, felonies are much more serious crimes that are classified by degrees. The most severe of these are first-degree felonies, while the least serious are sixth-degree felonies. When someone is charged with a felony, they may face hefty fines and a prison sentence of over a year in a federal or state institution. Those who have been convicted of a felony may encounter difficulties after their release, which is why it's crucial to have a reliable criminal defense attorney.
SC Code Section 16-1-20 provides us with a helpful penalty outline as it relates to felonies and misdemeanors:
It's important to note that these are maximum sentences, and the actual sentence may be less depending on the specific circumstances of the crime.
Hiring a criminal defense lawyer is a serious decision that should not be delayed. The longer you wait, the fewer opportunities you have for a positive outcome, as the penalties, fines, and potential jail time can increase. It's important to seek counsel from experienced criminal law attorneys, like Lauren Taylor Law, to protect your career, family, and personal freedom. When you work with our criminal defense law firm in South Carolina, you can rest easy knowing we:

If you have been accused of a crime, you and your family are probably curious about the process that lies ahead regarding your criminal case. Generally speaking, the process for criminal cases in South Carolina is as follows:
Investigation: Law enforcement will investigate and gather evidence before charging you with a crime.
Charges: After your arrest, you will have a trial to determine the charges being presented against you. It's recommended to find a lawyer as soon as possible to help defend your case.
Initial hearing: You will be brought before a magistrate judge to learn more about the charges being brought against you.
Discovery: Before the trial, the prosecutor and your attorney will gather evidence and information to prepare their cases. This includes finding witnesses to testify during the trial.
Plea bargaining: If the case against you is strong, the prosecutor may offer a plea deal to lessen the severity of the sentencing. If you plead guilty, there will be no trial, and the charges will be determined.
Preliminary hearing: In some cases, there may be a hearing to present evidence in your favor before the trial, after you have chosen to plead not guilty.
Pre-trial motions: Before the trial, the prosecutor can make a motion to decide on a certain issue. These motions range from dismissing a charge to moving the trial venue.
Trial: Both sides present their case during the trial and bring in evidence to convince the jury. Shortly after the trial, the verdict is announced.
By understanding the legal process for criminal cases in South Carolina, you can better prepare for what's ahead and work with your criminal defense attorney Near Me Seneca, SC, to defend your case.
Having served criminal defense clients in South Carolina for years, our team of experienced lawyers has worked with a litany of cases, from minor misdemeanors to serious felonies. We understand that no two issues are the same and that every client has unique needs and concerns regarding their case. We also understand that knowledge can go a long way, and as such, would like to summarize some standard cases our attorneys work with daily:
DUIs: Driving under the influence of alcohol or drugs can result in a fine or jail time. A SC DUI lawyer can defend your rights during your case.
Misdemeanors: These crimes are less severe than felonies and are usually punishable with fines and jail time. Many of the crimes we handle at Lauren Taylor Law are misdemeanors at the state level.
Burglary: When you enter a home and commit theft, you've committed a burglary. This crime is a felony and, as such, can result in up to 10 years of prison time.
Domestic Violence: This type of crime can range from abuse in the family home to a fight in public. Penalties for domestic abuse range in severity and can change if an injury is involved.
Drug Charges: Drug charges are very common in South Carolina and can range from possession, intent to deliver, and trafficking.
Shoplifting: This crime is a form of theft that may be classified as an infraction rather than a misdemeanor in certain cases.
Theft: Theft, or larceny, is defined as unlawfully taking possessions that belong to an entity or person. Theft is different from burglary and shoplifting, though prosecutors often stack those charges together.
Weapons Charges: Possessing, utilizing, or selling an unlicensed weapon are all examples of weapons charges, which can carry very serious consequences in South Carolina.
Juvenile Crimes: When it comes to criminal charges involving minors, the term "juvenile crime" refers to offenses committed by individuals under the age of 18. However, depending on the seriousness of the crime, some young people may face trial as adults.
Violent Crimes: When an individual is subjected to or threatened with violence, it is considered a violent crime.
Lauren Taylor Law is the go-to choice for clients who value honesty, hard work, and transparent communication. Our mission is not to judge individuals who have been accused of crimes. Rather, we aim to secure the best possible defense for our clients while upholding their rights and freedom. SENECA, S.C. —
It's the dawn of a new era for the Seneca Bobcats.
Following a 10-win season in 2025, former defensive coordinator Drec Ellis takes over as head coach of the Cats.
"We graduated a lot of guys right, we graduated a shrine bowl running back, we had a north-south quarterback, so graduating a lot of those big names, everybody's looking to see who's going to step up, so they're not really expecting the guys that we have to really burst on to the scene, but I truly feel like these guys are bought in and they're going to surprise a lot of people," Bobcats head coach Drec Ellis explained.
Offensively, five starters are back in the mix, three of whom play along the offensive line.
Those big bodies will look to protect first-year starting quarterback Eli Wiley.
Coach Ellis applauds Wiley’s growth from May to August, saying it’s been astronomical.
Defensively, the Cats return just three starters, but that's part of the reason why Ellis says a lot of folks are going to sleep on his team this season.
"At this point we're taking it one day at a time. I'm not trying to look too far down the line; we're focused on beating Seneca every single day, hoping that we're going against the best team that we're going to be facing throughout the year, and putting the pressure on each other to make sure we having continuous improvement," Ellis said.
"Obviously, we would like to win the region championship and do all those things like everybody else would, but we're not overly concerned about none of that stuff at all right now; we're focused on today," Ellis said.
The Bobcats' team motto is the acronym darts — discipline, accountable, relentless and tough.
Seneca opens up the season on the road against Powdersville on Friday night.

The park sits on 46 acres of land, on the shores of Lake Keowee in Oconee County.
Here are even more places to swim and splash near Greenville, SC!
This park is popular with upstate families because of the amenities and activities it offers. Whether you stay for just the day, or decide to camp at High Falls, there is no shortage of activities to keep you occupied. This was one of the first lakes we discovered when we moved here. The boat traffic is minimal and the shore doesn’t drop off like it does at some other upstate lakes.
Entry into the park is just $5 per car, paid in cash. Swimming at the lake is allowed. One of the reasons this park is so popular is because of the restrooms and playground in close proximity to the lakeshore. There are also shade trees to keep the sun off of everybody. These are all important features for families planning a day on the lake with children.
You will also find a mini-golf course that is BYOP (Bring your own putter and ball) to have fun within the cooler months or in between dips in the lake. This lake is also great for boating. It’s ok if you don’t have your own, you can rent kayaks at the park.
My children and I love kayaking. My son has his own and I have a tandem kayak. I’ve said it before, but a child-sized kayak was one of the best gifts Santa ever got my son. We didn’t even have an adult one when he did that. Santa sure knew what he was doing though, because that lit a fire in my children and I for exploring our waterways.
Paddling is something that I and my co-worker Kristina love, and if you have a chance to get your own – do it. They don’t require the same maintenance as a boat and can be found for just a few hundred dollars.
There are so many places in and around the Upstate to explore in a kayak. With that said, the water around High Falls County Park is a good place for a first-time lesson. The inlet to the right of the boat launch is a calm area within reach of the shore should you happen to need to swim to shore. I only say this in case you are a worrier, there is almost no chance you’d need to swim to shore.
My three-year-old desperately wanted to paddle on her own. She sat in front of my son in the tandem kayak and he taught her how to paddle. He was sharing a passion for paddling with his little sister, when normally they are screaming at each other. It was a peaceful day on the lake and one I won’t soon forget.
If an overnight adventure is what you seek, the park offers 91 campsites, with 10 of them being on those being on lake. Peak times for the campground are the months of May through September, with no camping in the winter months (December – February).
Campsites start at $25 a night and can be reserved through Reserve America. All the sites have electrical hook-ups and there is a bathhouse on site. Camping in the off-peak times is when I like to go. The cooler fall months are better for going without air conditioning, in my opinion.
The park has two fishing piers available to use. You’ll need to have an SC freshwater fishing license to fish in Lake Keowee. In the cooler months, the lake is known for its spotted bass fishing.
You can enjoy this park year-round, so don’t let the cooler weather stop you from going to explore High Falls County Park.

SENECA, S.C. —
The Seneca community is rallying behind a rodeo legend after a nasty fall landed him in the hospital.
Deep in the countryside of Oconee County, there is a lifelong rodeo legend by the name of Harold Miller.
His fans, friends and fellow riders know him fondly as "Cowboy," a man who never stopped believing in rodeo from the age of 8 to now, near 70.
Over bucking broncos and bulls is where you will find Miller, beaming from the rush he gets seconds before the charge.
"When that gate comes up, there's a big explosion. Here we go!" He laughed. "Do your job, you gotta do your job. Mark him out, get that neck and keep charging."
Miller always leaves the ring gnawing a toothpick, tipping his signature black hat and sporting a grin.
Miller overcame adversity in a historically segregated sport, becoming a multi-world champion in bareback rodeo riding and being inducted into the Black Cowboy Hall of Fame.
Miller retired from the sport in 2024. Since then, he has made a living training horses and fixing horseshoes alongside his wife, Mary Gardner.
"He's got patience, he's got the heart of gold. You never do wrong with him," Gardner said.
On Friday, Miller came out of retirement to fill in for an event in North Carolina. From there, an injury they never saw coming.
Right out of the gate, the wild bronco threw him into a pole, knocking Miller out.
"I've seen him bang his head 100 times on panels and shoots. He just comes out black and blue. But this one, I knew something in my heart had to be something else was wrong," Gardner said
Miller was airlifted to the hospital with severe lacerations and fractures to his face and head.
Somehow, Gardner said, he was smiling the whole time.
"His blood pressure never faltered through the pain, surgeries, anything," Gardner said.
"She was in worse shape than I was," Miller said.
"I was ... because this is my whole world right here," Gardner said, wiping away tears.
On Sunday, Miller returned home. And home is where we found him on Thursday, proudly sporting the scar, sitting on a straight-back chair.
"I still get a little dizzy. See that scar, man? Man. It'll heal up, and I'll cover it back up," Miller laughed.
While Miller is recovering, he and Gardner are unable to operate the farrier business, and medical bills are piling up.
Friends, fans and fellow riders are serving up support in more than one way.
"Once you know the fundamentals, you learn and grow from there. That's what he did for me," said Brian Massey, who owns Two Horse Distillery.
The restaurant is selling Rodeo burgers in the name of Massey's former trainer. And man, are they something special.
"$4 of every burger sold goes toward Harold and his recovery," Massey said.
Keep up with what's happening around our area by downloading the WYFF News 4 app on the App Store or Google Play.
The champion is not planning to hang his hat just yet. Miller said every fall is a lesson.
"I turn 70 in September. I don't see a lot of 70-something-year-olds hopping on," Miller said. "I'll probably get back on. Finish out with a good one."
"His pretty blue eyes are shining at me. That's what matters," Gardner said.
After recovery, he hopes to continue traveling and working on shoes and training young rodeo stars.
"You're Superman without a cape. There are not many people like Harold Miller," Gardner said.
"There probably aren't many people you'd really call 'Cowboy' in this area, but Harold truly is. I mean, that's his life," Massey said.
