Getting a Divorce in Mount Pleasant, SC

It's safe to say that nobody goes into a marriage expecting to get a divorce. But for many couples, divorce proves to be in their family's best interest. Before you go through with such a serious choice, it's prudent to ensure that you and your spouse agree that divorce is best. Sometimes, therapy or marriage counseling can save marriages. That's especially important if you have kids with your spouse.

If you have made efforts to salvage your marriage and have concluded that divorce is the only option, our team of passionate divorce lawyers is here to help. Divorces are complicated and often contentious, but in South Carolina, getting a divorce is different than in other states.

For example, in other areas of the United States, judges are obligated to split marital assets equally between spouses. However, South Carolina is not classified as a community property state. The judge in your divorce case could award your husband or wife a larger portion of the marital property you once shared. That scenario is even more likely if the judge decides you were the ultimate cause of the divorce.

Similarly, divorce judges in South Carolina have a higher chance of making you pay more substantial alimony payments for longer periods of time when compared to other states. To make matters even more complicated, divorce laws and tax consequences in South Carolina change often. Additionally, our state does not recognize the concept of "irreconcilable differences," meaning you cannot use it as a reason to divorce your spouse (or vice versa).

Legal Separation Mount Pleasant, SC

Understanding the Two Types of Divorces in South Carolina

In order to get a divorce in the state of South Carolina, a person must have legal grounds to do so. As such, you have two options:

  • A "Fault-Based" Divorce
  • A "No-Fault" Divorce

Many couples opt for a no-fault divorce, but in order to qualify, you and your spouse must prove that you haven't been living together for at least a year. Choosing this option is popular because it often helps couples avoid getting in a fight when one spouse blames the other for the marriage breakup.

Apart from one year of continuous separation, which is grounds for a no-fault divorce, the legal grounds for divorce in South Carolina include:

  • Physical Cruelty (Does not include mental cruelty or emotional abuse)
  • Adultery (Heterosexual or homosexual)
  • Habitual Drug Use or Drunkenness
  • Desertion (when one spouse leaves the marital home for longer than one year)
Child Custody Mount Pleasant, SC

Each fault-based reason listed above can play a part in the outcome of your divorce case, including decisions on child custody, alimony, division of debts, and division of marital property. When you account for the unique nature of divorces in Mount Pleasant and the rest of the state, foregoing a divorce attorney is a poor decision.

Do I Really Need a Divorce Attorney in Mount Pleasant, SC?

It's possible to get divorced in South Carolina without needing a lawyer. However, we've encountered situations where clients come to Lauren Taylor Law because they tried the process on their own with no success. When it comes to divorces in South Carolina, there are many procedural requirements to meet.

Your paperwork must be correct across the board. For instance, you and your spouse must both file accurate financial declarations in family court. If you've come up with a divorce agreement, the family court must still decide whether it's equitable and fair for your spouse and in the best interests of your kids.

If you choose to try and get a divorce in South Carolina on your own, we strongly recommend that you schedule a consultation at the very least. That way, you know your rights and have a minimum understanding of the divorce process in South Carolina.

Some of the most common benefits of hiring a divorce lawyer include:

  • Handling and Filing All Necessary Paperwork
  • Having an Advocate on Your Side
  • Protecting Your Children's Rights
  • Having Access to Reliable Legal Advice and Guidance
  • Amicable, Purposeful Communication with Your Spouse
  • Having a Simplified and Streamlined Divorce Process
  • Reminders About Pertinent Appointments and Court Dates

Understanding Child Custody in Your Divorce Case

Child custody cases present unique challenges for you, your spouse, and your family law attorney. They are almost all resolved through mediation or settlement conferences.

Unfortunately, when two parents have disagreements about child custody, calm discussions often devolve into quarrels and contentious disputes. If you and your spouse do not agree about visitation and custody rights for your child or children, a divorce judge will make those tough decisions for you. In this circumstance, child custody is determined by what the judge deems as the best interests of your children.

Fortunately, contrary to urban myth, divorce laws in South Carolina do not favor mothers of fathers or vice versa when it comes to child visitation and custody. There is also no "standard" schedule presented for child visitation. Factors that your divorce judge will pay close attention to include:

  • Who is the Primary Caretaker of the Child?
  • Is There Any History of Abuse or Neglect?
  • What Are the Conduct and Fitness of the Parents?
  • What are the Wishes of the Children?
  • Do Any Third Parties Have Opinions on the Child's Best Interests?
Abbeville Law Firm Mount Pleasant, SC

At the end of the day, children have the right to love each parent freely. However, protecting children during a custody battle is crucial. At Lauren Taylor Law, our team works closely with you, your children's Guardian Ad Litem (who represents the children in the legal case), their school teachers, and any third party working with your children. Advocacy for the best interest of your children requires deep understanding, legal skills, and years of relevant experience. With the Lauren Taylor Team in Mount Pleasant, SC, you can rest easy knowing your child's future is of utmost importance.

Child Support Laws in South Carolina

If you're getting a divorce, and you have a child or children with your former spouse, there's a good chance you're worried about how much child support you'll have to pay. You may be wondering, "How is child support in South Carolina determined?"

The amount of child support you must pay is dictated by the child support guidelines in South Carolina. These guidelines not only calculate temporary child support but permanent support as well. These guidelines are applied to any case where the parent's gross combined income is less than $15,000 a month. According to the law, child support amounts are calculated with these factors in mind:

  • The Number of Children in the Marital Home
  • How Many Nights the Child Spends with Parents
  • Whether or Not Alimony is Paid
  • Who Will Be Paying for the Child's Health Insurance
  • How Much That Parent Will Pay for Their Child's Health Insurance
  • Who Will Be Paying for the Child's Extraordinary Medical Expenses
  • How Much That Parent Will Pay for Extraordinary Medical Expenses
  • How Much That Parent Will Pay for Work-Related Childcare
  • Who Will Be Paying for Work-Related Childcare
Marital Disputes Mount Pleasant, SC

Without a divorce attorney in Mount Pleasant, SC, navigating the turbulent waters of child support is nearly impossible. With years of experience, we have the tools and resources to protect your rights and guide you through the child support process. What is Alimony in South Carolina?

Alimony is financial support that you must pay to your former spouse. In South Carolina, there are different types of alimony. Permanent, periodic alimony is paid on a set schedule over time. However, alimony terminates when you or your spouse dies or when a receiving spouse begins to cohabitate with another person or chooses to remarry. Alimony in South Carolina can be modified based on a showing of a substantial change in circumstances.

In some cases, spouses choose to pay a lump sum alimony. The amount is agreed upon by both parties. This can usually be paid all at once or in a schedule of payments. It should be noted that spousal support may be ordered, pending your final divorce.

Legal Consultation Mount Pleasant, SC

South Carolina law requires Family Law Courts to consider a number of factors in making a ruling on an alimony request. Those factors include:

  • Duration of Your Marriage, Including You and Your Spouse's Age at the Time of Marriage and Divorce
  • Employment History and Earning Potential of You and Your Spouse
  • Current and Reasonably Anticipated Earnings of You and Your Spouse
  • Current and Reasonably Anticipated Expenses and Needs of You and Your Spouse
  • The Physical and Emotional Condition of You and Your Spouse
  • Marital and Non-marital Properties Belonging to You or Your Spouse
  • Fault of Either Spouse or Marital Misconduct
  • Existence and Extent of Support from a Previous Marriage
  • Tax Consequences of Support Award
  • Custody of Minor Children

CHARLESTON — Small Business Saturday may have been founded by one of the largest credit card companies in the U.S., but the spirit to support local is strong, especially in the Lowcountry.

American Express originated the idea in 2010 to encourage consumers to shop small during the holiday season. It gained government support a year later when the U.S. Small Business Administration became a co-sponsor.

In the Charleston area, supporting small makes the economy tick.

For every dollar spent in a local establishment, about 67 percent stays in the community, supporting neighborhood families and helping to “preserve the personality” that makes this area so special, said Matt Brady, economic development director for the Town of Mount Pleasant.

“Supporting local businesses is one of the most powerful things we can do as a community,” he said.

He added, “You are not just making a purchase, you are investing in your neighbors and strengthening the small businesses that give our town its special character.”

Mount Pleasant's locally owned shops, include Drifter Merch, owned by Lorrie Dixson Griggs. Founded in 2016 out of a deep-rooted love for live music, Drifter Merch has grown into a thriving hub for music enthusiasts, offering more than 60 high-quality, band-inspired designs from Widespread Panic and Billy Strings to the Grateful Dead and Willie Nelson in the form of T-shirts, hoodies, hats, accessories and more.

“Drifter Merch was built by fans, for fans,” Griggs said. “Every piece we create is meant to capture the spirit of the music that brings us all together.”

Mount Pleasant also has multiple bookstores. Pick up a new or secondhand book at The Village Bookseller, the buy-sell-trade shop Trade-A-Book and The Archive, which also offers coffee, wine and snacks.

Cara Otto, owner of her own small business — furniture and home-décor company Indigo Refurb — said an unknown gem is Grammy’s Attic off Clements Ferry Road.

“Also Eclectic Finds in Mount Pleasant is a mall with tons of small businesses inside featuring home décor, furniture, collectibles, body care products and so much more,” Otto said. “Both are great options for shopping small.”

For locals Julie Collins and Connie Robertson, they recommend Yesterday’s and Today's Unique Treasures in Moncks Corner.

With more than 50 small businesses under one roof, Robertson said, “it is a fantastic store with so many unique vendors truly has something for everyone!”

On James Island, Lounge with Us has the cozy factor with lounge clothes, pajamas and accessories.

The Cannonborough-Elliottborough district in downtown Charleston is a trove of small women-owned shops. There’s The Paper Canopy with curated cards, stationery and an adorable children’s section. Taxidermy features luxury exotic leather handbags, shoes and jackets in statement-making colors. And Tiny Tassel is known for its beaded jewelry and bags.

Shoppers can also dine at Pink Cactus or a number of the new restaurants around Spring Street, or grab some fresh groceries at The Veggie Bin.

A number of businesses on Oprah’s “Best Charleston-Made Holiday Gifts” feature favorites sold here in the Holy City. The list includes a bow tie from West Ashley-based Brackish, jewelry from woman-owned Hermosa and award-winning tea at veteran-owned Oliver Pluff & Co.

In North Charleston, Park Circle has The Station and Odd Duck Market for shopping; Paddock and Whiskey, Orange Spot and Common House Aleworks for dining; and Park Circle Ceramics for a fun and inexpensive spot to make your own gifts.

And while not open yet, Off Track Ice Cream on Beaufain Street is moving to Park Circle soon.

In West Ashley, visit local favorites like Consign Charleston, where shoppers can find gently used clothing, collectibles and furniture on a budget, or Charmed Beauty Gifts and Apparel and Rhodes Boutique, which have an array of Southern-inspired jewelry, gifts, apparel, handbags and more. Garfield Jewelers also has an ever-changing selection of estate jewelry, Charleston-themed rice bracelets and seasonal gifts, while local record store Monster Music and Movies offers the Southeast’s largest selection of vinyl records, CDs, DVDs, Blu-ray and cassette tapes.

Hungry? Grab a bite at Betty Lou’s Bistro or Cafe Roca, or satiate your sweet tooth at Christophe’s Macaron et Chocolat. Betty Lou’s is run by Kris Kincaid, also the owner-operator at local Cannon Distillery.

Or take a drive to Owlbear Cafe in Mount Pleasant, where the extensive library of board games are free to use.

Lowcountry Local First has more than a dozen pages of small businesses you can shop and support on Nov. 29.

Kelsea Ballerini's new EP is named "Mount Pleasant," and it's almost certainly in reference to the local town where she spent a good amount of her time while dating "Outer Banks" star Chase Stokes.

The two reportedly started dating in 2023, making it official at the CMT Music Awards red carpet that April. They then split in September of this year but have since been seen together and are believed to be working things out, according to Us Weekly, Elle, Taste of County, InStyle and other publications.

Ballerini's EP, released on Nov. 14, references some of the struggles in her relationship with Stokes.

In her new song "587," she references Mount Pleasant specifically.

"587, 587 / Baby, that's the distance, path of least resistance / 587, here to Mount Pleasant / Got me reminiscing / It used to be a quick flight / By midnight we were kissing in the harbor / Now you've never felt farther," Ballerini sings.

When Stokes was filming the hit Netflix show in Charleston from 2023 into this year, Ballerini would visit. "The Voice" coach has been spotted around town, including at The Obstinate Daughter on Sullivan's Island, Record Stop in downtown Charleston and the Old Village and True Blues House of Wings in Mount Pleasant.

"One thing you should always know about me is I'm going to find a karaoke bar, and Blues Bar is that go-to spot for me in Charleston," Ballerini is quoted saying via Apple Maps' curated Hyperlocal guide. "It's kind of a hole-in-the-wall in a strip mall, and that's everything you need to know. I'll see you there!"

She also performed at the North Charleston Coliseum in April of this year. The Post and Courier interviewed her before the show.

“It's my second home at this point,” Ballerini said of Charleston at that time. “It's really cool to be able to play shows in cities that have my heart tied to them, whether that be Nashville or Charleston. I have friends there, obviously, because I live there part-time, and I get to go home after the show. It'll be extra special to get to do that.”

Stokes and Ballerini have been spotted holding hands in Scotland and Croatia over the last few weeks. Part of the last season of "Outer Banks" is reportedly being filmed in Croatia, bringing Stokes there for filming. A source told Us Weekly that the two fell back into their romance "very naturally."

Previously, Stokes dated "Outer Banks" co-star and his character's love interest, Madelyn Cline. The two ended things in November 2021.
