Could you imagine waking up to a knock on your front door in the middle of the night, where police inform you that your aunt was killed by a drunk driver?

It's a troubling thought to ponder, but these events happen every day of every year in the United States. For the family members facing the future without their loved ones, talking about a wrongful death case can be difficult and even feel gross. Is it right to put a price tag on another person's life? While that question isn't easily answered, the reality is that losing someone unexpectedly can have far-reaching financial reverberations.

In the unfortunate event of losing a loved one due to the negligence of another party, pursuing a wrongful death lawsuit can provide both financial stability and hold the responsible party accountable. Understanding Wrongful Death Claims in South Carolina

Despite the popular misconception, wrongful death claims in South Carolina are considered civil suits. These cases are meant to give close family members the opportunity to seek compensation after their loved one dies. Wrongful death lawsuits are separate from the criminal proceedings that often occur when a person dies.

In South Carolina, a wrongful death is defined as a death "caused by the wrongful act, neglect, or default of another." According to South Carolina law, in wrongful death cases, the at-fault person or party will be liable for damages equal to that of the deceased, such as they would have been able to claim through a personal injury case if they had survived.

Who Files Wrongful Death Claims in South Carolina?

One of the most commonly-asked questions we receive at Lauren Taylor Law as it relates to wrongful death claims is, "Who needs to file my family's wrongful death claim?" Although a wrongful death claim may bear some similarities to a personal injury lawsuit, it is important to note that they are distinct legal actions. The deceased party cannot represent themselves in a wrongful death suit, so instead, it's up to the remaining family members to determine who is eligible to file the claim.

In South Carolina, a wrongful death claim must be filed by the administrator or executor of the deceased's estate and is usually done so with the guidance of a wrongful death attorney in Clemson, SC. If the estate does not have an appointed administrator, the court can appoint one. It is important to note that even if you are not the executor, you may still receive compensation. The executor acts on behalf of all remaining family members, including children, the spouse, or parents.

If you're wondering whether you can file a wrongful death suit or if one is even feasible to file for your unique circumstances, contact Lauren Taylor Law today. It would be our pleasure to give you the guidance and confidence you need in such a trying time.

Wrongful Death Actions vs. Survival Actions

A wrongful death claim seeks to compensate surviving family members for the economic and general damages they have suffered and will continue to endure as a result of their loved one's passing. To succeed in such a claim, plaintiffs must demonstrate that the defendant's negligence caused the death. In contrast, a survival action enables the estate of a deceased individual to seek compensation for the pain and suffering they experienced due to the injuries that led to their death. This typically encompasses medical expenses and compensation for the conscious pain, suffering, or mental anguish that the deceased endured prior to passing.

Unlike a survival action, compensation for a wrongful death lawsuit may include:

  • Expenses relating to burials and funerals
  • Costs associated with fatal injuries of the deceased
  • Lost benefits and wages, including what the deceased person may have earned over the course of their life
  • Loss of companionship
  • Protection and guidance
  • Mental anguish

Proving Wrongful Death in South Carolina

In South Carolina, wrongful death cases revolve around the concept of duty of care. This means that individuals have a responsibility to behave in a certain manner, and failure to do so is considered negligence. For instance, employers are required to provide a safe work environment, and drivers have the responsibility to drive carefully.

A death is wrongful in South Carolina when:

  • A defendant owes the deceased a duty of care
  • A defendant doesn't meet the duty of care, which in turn causes a death
  • The duty of care is breached and that breach causes surviving family members damages

In order to prove wrongful death in a South Carolina courtroom, it's crucial you work with a knowledgeable wrongful death lawyer in Clemson, SC. Without an attorney by your side, proving negligence of the at-fault party is an uphill battle that can cost you large amounts of time, money, and stress.

Why Hire a Wrongful Death Attorney in Clemson, SC?

Speaking of wrongful death lawyers in South Carolina, another common question we hear about is whether or not a person should hire an attorney to oversee a wrongful death case. The simple answer is a resounding "Yes," though every person may have different reasons and goals for doing so.

While grieving the loss of a loved one may take precedence over legal action, it's essential for surviving family members to consider retaining a wrongful death lawyer as soon as possible. Not only can a lawsuit help ease the financial burden that comes with losing a loved one, but there is also a time limit for submitting a wrongful death claim.

This time limit, known as the statute of limitations, varies from state to state and type of lawsuit. In South Carolina, plaintiffs have three years from the date of death to file a wrongful death claim. Therefore, it's crucial to act quickly and seek legal representation from experienced wrongful death attorneys, such as those at Lauren Taylor Law.

With a proven track record of recovering compensation that recognizes the value of the deceased, our attorneys can help you through this difficult time. Here are just a few of the most common ways we do so:

This week, Clemson added another trophy to the cabinet, but this wasn’t a team award. Junior linebacker Sammy Brown was honored with the Blanchard-Rogers Award, which honors the most spectacular athlete in the state of South Carolina.

The sky is the limit for Brown, who seems to just keep getting better.

After receiving the 2024 ACC Defensive Rookie of the Year award, Brown turned around and posted an even stronger sophomore campaign, now appropriately honored by the Roger-Blanchard award.

With 106 total tackles (51 solo), five sacks and a forced fumble and an interception a piece, Brown caused mayhem in the 2025 season.

But in a year where Clemson drastically underperformed by many metrics, Brown was undoubtedly a bright spot, and he recognized that this season taught him lessons beyond football.

“There's just so much that I can give credit to this season. It's not all bad can come from, you know, having a bad season,” Brown said after a loss to Penn State in Clemson’s bowl game capped the season at 7-6.

Since its inception in 2013, Brown is the seventh Clemson player to be selected for the award. But in receiving the award, Sammy Brown is breaking a trend that has strongly favored the Tigers’ foe: the South Carolina Gamecocks.

The Cocks have dominated the award since Jalin Hyatt received it in 2022. Then, it was Xavier Legette, followed by Kyle Kennard, who received the nomination last year.

In its early years, the award essentially functioned as Clemson’s “best player” honor, with the Tigers claiming five of the first six selections.

Returning the award to upstate South Carolina, Brown joins the elite company of Trevor Lawrence, Deshaun Watson, Travis Etienne Jr., Vic Beasley and Tajh Boyd.

Brown is the first Clemson defensive player to win the award since Vic Beasley.

Brown will be formally honored by the South Carolina Hall of Fame on April 16, 2026 at Hotel Hartness in Greenville, South Carolina.

Heading into his third season with Clemson, Brown will be leaned on heavily in 2026. Now as a veteran with several elite awards and recognitions, Brown will be a backbone relied on for leadership and direction — and he knows it.

“Its going to be really tough and a lot of guys are going to have to take on new new roles and I'm going to have to step into the into the leadership role and take on being more of a vocal leader,” Brown said. “It's going to be tough, but it's going to be a new journey for me, a new journey for this team and I'm really excited and looking forward to that.”

Clemson University has grown to become the most active research institution in South Carolina, according to data from the National Science Foundation (NSF).

Clemson’s total research and development (R&D) expenditures topped all South Carolina universities for the first time at $339 million in 2024, the latest year for which data is available for all universities in the NSF Higher Education Research and Development Survey. Total R&D includes competitive grants from the federal government, institutional spending, state support and investments from the private sector and nonprofit foundations.

“We have aligned our research strengths with state and federal priorities in energy resilience, national security, advanced manufacturing, health, agriculture and critical technologies to push meaningful innovation and scientific discovery that benefits the public and the state’s economy. We appreciate the investment in our work,” said Tanju Karanfil, senior vice president for research, scholarship and creative endeavors.

Clemson researchers are working directly with farmers, utilities, manufacturers, medical providers, K-12 schools, employers, state agencies, community organizations and others to help improve the economy and lives across South Carolina through workforce development and innovation.

Dominion Energy South Carolina and TECO Westinghouse Motor Company, for example, are working with Clemson on a new transformer device that can prevent outages during disruptions caused by fallen tree limbs and other disturbances. Prisma Health recently recognized a Clemson faculty member for research on reducing hospital readmissions. A Clemson research team was recognized nationally for helping more than 1,500 South Carolinians better manage diabetes. Clemson scientists developed new dry pea cultivars to give South Carolina farmers a new revenue stream for acreage typically left fallow or planted with cover crops over the winter. Clemson researchers are helping K-12 school districts in South Carolina adapt to the advent of artificial intelligence. These are a few examples.

“Clemson research is defined by bold ideas, broad collaboration and big impact,” Karanfil said in announcing Clemson’s total R&D figures at the University’s Board of Trustees meetings last week.

In the past five years, Clemson research has supported nearly 1,400 Ph.D. completions and 9,000 master’s degree completions, funneling a pipeline of talent to the state and regional workforce. Thousands of undergraduate students participate in research each year, as well, gaining unique experiential learning opportunities to prepare them for work after graduation.

Additionally, Clemson research has spawned 24 startup companies over the past five years and led to 304 invention disclosures, 83 patents and 80 licenses and options in which businesses are putting Clemson innovation to work.
